Geschäftsbedingungen:
Es gelten die Allgemeinen Geschäftsbedingungen für Fotografen herausgegeben von der Bundesinnung der Fotografen und dem RSV. Darüber hinaus gelten die Nutzungsbedingungen.

Nutzungsbedingungen:
(1) Jegliche Verwendung und Verbreitung der Fotografien darf nur unter Anbringung der Herstellerbezeichnung © Gerald Zugmann/Wien - direkt bei der Abbildung oder zumindest eindeutig zugeordnet - erfolgen. Bei Verwendung im Internet ist diese Herstellerbezeichnung als Link zu www.zugmann.com auszuführen. Die Unterlassung der Copyrightangabe wird mit einem 100%igen Aufschlag auf das vereinbarte Bildhonorar geahndet.

(2) Nach Drucklegung ist ein Belegexemplar zuzusenden.

(3) Vereinbarte Honorare sind binnen 14 Tagen ab Rechnungslegung fällig. Danach werden Verzugszinsen verrechnet.

(4) Die Nutzungsbewilligung gilt erst mit Bezahlung der Rechnung als erteilt.

(5) Die Zusendung der Duplikate/Prints/Daten erfolgt leihweise. Sämtliches bereitgestelltes Material bleibt im Eigentum der Gerald Zugmann Fotografie KEG.

Das übermittelte Bildmaterial (analog oder digital) darf nur im vereinbarten Umfang und nur für die vereinbarten Zwecke genutzt werden. Eine elektronische Speicherung ist nur für die Dauer der Verarbeitung im Rahmen der vereinbarten Nutzung gestattet. Eine dauerhafte Speicherung in elektronischen Archiven, Datenbanken, auf CD-ROM und ähnlichen Datenträgern oder auch in analoger Form (Vergrößerung, Ausdruck, Diaduplikat u.ä.) ist nicht erlaubt. Digitale Bilddaten sind nach Ausübung der eingeräumten Nutzungsrechte von allen Rechnern und externen Datenträgern des Nutzers zu löschen.

(6) Jede Veränderung (Farbanpassungen, Nachschärfen u.ä. ausgenommen) und Umgestaltung der Photos ist nur mit schriftlicher Zustimmung der Gerald Zugmann Fotografie KEG zulässig.
Darüber hinaus gelten die Geschäftsbedingungen.

Erfüllungsort und Gerichtstand ist Wien. Es gilt österreichisches Recht.

The terms of use developed by these organizations are to be considered as applying to this website.

Terms and Conditions of Use
(1) All publications of the photographs must be credited to the author as © Gerald Zugmann/Vienna. This credit line must be located directly beneath the photograph or clearly related to the photograph. For online use of photographs the credit line must function as a link to www.zugmann.com. Failure to display the author's name will result in an additional charge amounting to 100% of the original fee.

(2) Upon publication a copy of the issue / book must be sent to Gerald Zugmann Fotografie KEG.

(3) Fees agreed upon are to be paid within 14 days of the date of the invoice or a late payment fee will be incurred. A holding fee will be incurred if the agreed time frame for review or reproduction of the duplicates or prints is exceeded.

(4) The terms of use are conditional until full payment of the reproduction fee has been received.

(5) The transmitted images (analog or digital) are not to be used in any manner other than according to the terms of use agreed upon.

Electronic storage of the images is permitted only for the duration of the transmission according to the terms agreed upon. Any form of permanent storage in electronic archives, databases, CD-ROMs or any other storage media, let them be digital (any form of data carrier) or analog (enlargements, prints, duplicates of transparencies, etc.) is prohibited. Digital images are to be permanently removed from all computers and external data carriers when the time frame agreed upon according to the terms of use has expired.
(6) Any alterations (except adjustments to color or sharpness, etc.) and changes in design of the images can be undertaken only with written consent by Gerald Zugmann Fotografie KEG. In addition, the General Terms and Conditions remain valid.
